§ 11-2-16. Certificate constitutes franchise; subject to revocation.

  • (a)

    A certificate shall constitute a franchise from the city for the operation of taxicabs within the city up to the maximum number named in the certificate. The city council shall have the authority to revoke a certificate in its discretion. The city manager has the authority to suspend a certificate for up to 30 days, pending city council decision. Upon revocation or suspension, the certificate is to be turned over to the taxicab inspector and taxicab operations thereunder are to cease immediately.

    (b)

    No certificate shall be revoked or suspended until the certificate holder has had at least five (5) days notice by personal service or by certified mail directed to the address on its application, stating briefly the basis for the revocation or suspension and the time and place of a hearing. After the hearing, the city council or the city manager shall have the power to revoke or suspend a certificate or to conditionally revoke or suspend the certificate upon compliance with an order as fixed by city council or the city manager.
