§ 12-3-2. Enforcement authority; right of entry.

  • (a)

    It is the duty of the director of planning and development, or his designee, to enforce all of the provisions of this chapter, unless otherwise specified, and shall have such powers as may be necessary or convenient to carry out and effectuate the purpose and provisions of this chapter, including the authority to make all inspections necessary to determine whether the provisions of this chapter are being met. The director, or his designee, shall be authorized to enter upon and within premises and buildings for the purpose of making examinations and investigations; provided that such entries shall be made at reasonable hours in such a manner as to cause the least possible inconvenience to persons in possession.

    (b)

    In the event of a stormwater violation, as defined in sections 12-3-1(12) and 12-3-1(13), the director of public services will enforce all provisions as described in the above section.
